Operator and scope

XVitalLink operates NomiDay, a distinct product brand. These Terms are between you and XVitalLink and cover the website and NomiDay services. They do not replace the Apple Standard EULA governing the App Store app license or mandatory consumer rights.

Apple Standard EULA

Adults and permission

You must be an adult with legal capacity to agree. Before handling another person's information or acting for them, obtain their permission or other lawful authority. Respect their choices and applicable capacity and privacy protections.

Accounts and invitations

Provide accurate account information. Protect account access and invitation codes; do not publish them. Invite only trusted people with permission, review their roles and access, and contact support about suspected unauthorized use.

Lawful use

Use NomiDay for lawful personal and family purposes. Do not access accounts without permission, interfere with the service, abuse people, upload unlawful content or infringe privacy or intellectual-property rights.

Your content

You retain ownership of your content. You grant XVitalLink a limited, nonexclusive license to host and process it only to operate, secure and support NomiDay under the Privacy Policy. You must have authority to submit and share it.

Optional AI and location

Optional AI can produce incorrect or incomplete answers; verify important details. It is not professional advice. Optional location features depend on device permissions and family sharing choices described in the Privacy Policy; they do not guarantee continuous tracking or emergency response.

Safety limits

NomiDay supports family organization and connection, not diagnosis, treatment, medical monitoring or emergency dispatch. Do not rely on it for urgent decisions or as a substitute for qualified professionals or local emergency services.

Family Plus and members

The account owner purchases Family Plus for the circle. A circle supports up to 5 people total, including the owner; invited caregivers do not buy a separate subscription. Prices and available offers are shown before purchase in Apple's checkout.

Apple billing, trials and refunds

Apple manages App Store billing. Subscriptions renew automatically unless canceled in Apple Subscriptions. Trials depend on eligibility and the displayed offer; to avoid trial renewal, Apple advises cancellation at least 24 hours before it ends. Request refunds through Apple; eligibility and approval follow Apple's process and applicable law, without waiving mandatory local consumer rights.

Account deletion and billing

You may stop using NomiDay and request account deletion under the Privacy Policy. Shared-circle owners must transfer ownership first. Deleting the app or account does not automatically cancel an Apple subscription; cancel it separately in Apple Subscriptions.

Availability, changes and restrictions

Features may change or be interrupted; support is not 24/7 or an emergency service. We will give reasonable notice of material Terms changes. We may proportionately restrict or terminate access for serious violations, security risks or legal requirements, with notice when reasonably possible. Contact support@nomiday.app for help.

Legal protections and contact

The service is provided as available only to the extent permitted by law. No disclaimer or liability limitation excludes mandatory rights or liability that cannot lawfully be excluded, including fraud, gross negligence, death or personal injury. California law applies without overriding mandatory protections where you live. Privacy rights remain unaffected. Contact support@nomiday.app.
